Welcome to DreamingAisles! The terms "we", "us" and "our" refer to DreamingAisles. DreamingAisles operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). DreamingAisles is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with, or purchasing from our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.


 

SECTION 1 - ACCESS AND ACCOUNT


By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the Services.


 

To make purchases or access certain features, you may be asked to provide information such as your name, email address, billing address, shipping address, and payment details. You represent and warrant that all information you provide is correct, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all activity under your account.


 

SECTION 2 - PRODUCTS & SERVICES (DIGITAL & PHYSICAL)

We have made every effort to display as accurately as possible the colors, images, and descriptions of our physical products and digital files. However, appearance may vary depending on your device, screen configuration, or display settings.

  • Digital Products: Digital products (including downloadable audio files, ambient soundscapes, digital templates, and printable workbooks) are delivered electronically. You are granted a limited, personal, non-exclusive, non-transferable licence to use them as set out in Section 18 (Digital Products & Licence).

  • Physical Products: Physical items are packaged and dispatched to the shipping address provided at checkout.

  • Product Availability: We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction on a case-by-case basis. All descriptions of products and pricing are subject to change at any time without notice.

SECTION 3 - ORDERS, CANCELLATIONS & REFUNDS

When you place an order, you are making an offer to purchase. DreamingAisles reserves the right to accept or decline your order for any reason.

  • Physical Products: Orders for physical goods are subject to our Physical Shipping & Returns Policy.

  • Digital Products: Because digital content is delivered electronically, change-of-mind cancellations or refunds are governed by our Return and refund policy, subject to your statutory rights.

  • Commercial Resale: You represent and warrant that all purchases are strictly for your own personal, family, household or classroom use and not for commercial resale, public distribution, or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be specified in your order confirmation email.

Unless expressly stated, posted prices do not include sales taxes, VAT, duties, shipping, or customs charges, which will be calculated and added during checkout where applicable. You agree to provide current, complete, and accurate purchase and account information for all transactions.

SECTION 5 - SHIPPING, DELIVERY & DIGITAL TRANSMISSION

  • Physical Goods: Delivery times are estimates only and cannot be guaranteed. We are not liable for shipping delays caused by carriers, customs processing, or events outside our control. Title and risk of loss for physical items pass to you upon delivery to the carrier.

  • Digital Goods: Digital products are delivered via direct download links or email access. We rely on third-party infrastructure (such as web hosts and email networks) to deliver digital files and are not liable for temporary transmission delays or internet service interruptions beyond our control.

SECTION 6 - INTELLECTUAL PROPERTY & USAGE RIGHTS

Our Services and all content—including text, graphics, logos, images, audio clips, soundscapes, printable workbooks, video, software, and overall visual design—are owned by DreamingAisles, its licensors, or suppliers, and are protected by applicable intellectual property laws.

  • Allowed Use: You may use the Services for personal, non-commercial purposes only. For printable digital files, you may print unlimited copies for yourself, your family or your own classroom, as set out in Section 18.

  • Prohibited Use: Except as permitted by Section 18, you must not reproduce, duplicate, copy, sell, resell, distribute, publicly display, host on public drives, or exploit any portion of our digital files, physical products, or Services without our prior express written permission.

SECTION 7 - THIRD-PARTY TOOLS & LINKS

We may provide access to optional third-party tools, platforms, or website links (including embedded features or payment gateways) over which we have no control or input. You acknowledge that access to such tools is provided "as is" and "as available" without warranties of any kind. Use of any third-party tools or links is entirely at your own risk.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

DreamingAisles is powered by Shopify, which provides the e-commerce platform that enables us to sell our products and Services to you. You acknowledge and agree that your sales contract is made directly with DreamingAisles, and Shopify is not responsible for any aspect of sales, product fulfillment, or claims arising between you and DreamingAisles.

SECTION 9 - USER FEEDBACK AND REVIEWS

If you submit or post suggestions, ideas, product reviews, or other content ("Feedback"), you grant DreamingAisles a non-exclusive, perpetual, worldwide, royalty-free license to use, publish, reproduce, and distribute that Feedback in any media for marketing, operational, or promotional purposes.

SECTION 10 - PROHIBITED USES

In addition to other prohibitions set forth in these Terms, you are strictly prohibited from using the site, its content, or products:

  1. For any unlawful or fraudulent purpose.

  2. To infringe upon or violate our intellectual property rights or the rights of others.

  3. To upload viruses, malware, or malicious code.

  4. To scrape, crawl, or extract data using automated tools or AI agents without explicit permission.

  5. To resell, share, or publicly distribute our digital files or printed copies of our workbooks.

SECTION 11 - DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED BY DREAMINGAISLES, THE SERVICES AND ALL PHYSICAL AND DIGITAL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Statutory Rights Notice:

Nothing in this Section shall exclude, limit, or restrict any statutory warranties or rights granted to consumers under applicable law that cannot be lawfully excluded. If you reside in the UK or EU, your statutory rights under consumer protection laws—including your right under the UK Consumer Rights Act 2015 to receive physical goods and digital content that are of satisfactory quality, fit for purpose, and as described—remain fully intact and unaffected.

SECTION 12 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL DREAMINGAISLES, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS.

Mandatory Liability Saving Clause:

Notwithstanding anything to the contrary, nothing in these Terms excludes or limits our liability for:

  1. Death or personal injury caused by our negligence;

  2. Fraud or fraudulent misrepresentation;

  3. Any statutory remedy for defective physical goods or faulty digital content under the UK Consumer Rights Act 2015, EU Consumer Rights Directive, or equivalent local consumer protection laws; or

  4. Any other liability that cannot be lawfully excluded or limited under applicable law.

SECTION 13 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless DreamingAisles, Shopify, and our affiliates, officers, directors, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or third-party rights.

SECTION 14 - SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. These Terms and any policies posted by us constitute the entire agreement between you and DreamingAisles.

SECTION 15 - GOVERNING LAW & JURISDICTION

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of England and Wales [or your local operating jurisdiction].

Consumer Rights Exception: If you are a consumer residing in the United Kingdom or European Union, you will also benefit from any mandatory statutory consumer protections of the law of the country in which you reside, and you may bring legal proceedings in your local courts.

Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.

SECTION 18 - DIGITAL PRODUCTS & LICENCE

Your purchase gives you a personal licence: print unlimited copies for yourself, your family, or your own classroom. You may not resell, share, redistribute or commercially reuse the PDF file or its content.

Digital files, designs, artwork and text supplied by DreamingAisles remain the copyright of DreamingAisles. Digital files are licensed to you, not sold.

Each purchase covers the buyer who purchased it. Other teachers, schools or families who wish to use the files should buy their own copy.

Nothing in this Section 18 affects your statutory rights under the UK Consumer Rights Act 2015 or any other applicable consumer law.
